These Terms & Conditions ("Terms") govern your access to and use of the EDC Suite PRO WEB application, related tools, APIs and services (together, the "Service") operated by FWP Racing Solutions ("we", "us", "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
Some features require a paid subscription or the purchase of credits. Prices, credit allowances and plan limits are shown at the point of purchase. Unless stated otherwise, subscriptions renew automatically for successive periods until cancelled, and fees are non-refundable except where required by law. We may change pricing on a prospective basis with reasonable notice.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own professional or personal tuning work. You may not resell, sublicense, rent or provide the Service to third parties as a bureau service unless we have agreed this in writing.
You retain ownership of the calibration files, maps, templates and other data you upload or create ("Your Content"). You grant us a licence to host, process, back up and display Your Content solely to operate and improve the Service. You represent that you have the necessary rights to upload and modify any file you use with the Service and that doing so does not infringe the rights of any third party, including the intellectual property rights of vehicle or ECU manufacturers.

The Service is a tool for editing calibration data. It does not tune your vehicle for you and does not guarantee that any modified file is safe, functional, legal or suitable for any particular vehicle. Modified calibrations may be intended for closed-course, competition or off-road use only and may not be legal for use on public roads. You are solely responsible for ensuring that any changes you make comply with the emissions, safety and roadworthiness laws of your jurisdiction. We are not responsible for engine, drivetrain or component damage, warranty loss, failed inspections, or any other consequence arising from the use of files created with the Service.
The Service, including its software, design, trademarks and documentation, is owned by FWP Racing Solutions and its licensors and is protected by intellectual property laws. Except for the licence expressly granted above, no rights are transferred to you.
The Service may integrate with or link to third-party products (for example payment processors or mapping data providers). We are not responsible for third-party services, and your use of them is governed by their own terms.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, FWP Racing Solutions shall not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless FWP Racing Solutions from any claims, damages, liabilities and expenses arising from your use of the Service, Your Content, or your breach of these Terms.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required for security, legal or operational reasons. On termination, your right to use the Service ends; provisions that by their nature should survive (including sections 4, 6, 7, 9, 10 and 12) will continue to apply.
These Terms are governed by the laws of [jurisdiction — please confirm], and the courts of that jurisdiction shall have exclusive competence over any dispute, without prejudice to any mandatory consumer protection rights you may have.
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after the changes take effect constitutes acceptance of the revised Terms.
